Actually it is a breach of the Lisbon Treaty, which has Human Rights declarations built into it. If Kronofogen was taken to the European Court of Human Rights or the European Court of Justice, it would definately lose on the basis of unreasonable punishment for the very long periods of times it makes a person suffer and for the continuing black marks on credit ratings, long after the event, quite often in decades. Whats wrong is Swedish have not got it into there heads that they can take court cases to the European courts, which would change the nature of Swedish law for the better, very quickly. |

I was under the impression that while Kronofogden can add black marks to your credit, it's not actually them who maintain the credit reports. Something abbreviated to UC or something like that. Am i just misunderstanding?

You are absolutely correct on the second point. Kronofogden is just the national debt collector. They don't handle any registers nor add any "black marks". Private credit rating companies like Upplysningscentralen UC, Soliditet and Dun & Bradstreet continuously collect financial information about people, from several sources (one being Kronofogden). The "black mark" thus has nothing to do with kronofogden; it is something the credit rating companies use to indicate that you have had problems with your payments. Hence, all of Nemesis BS above is moot, as usual... |

So Bender, far as I understand it the same happens in Britain, except that you have to have gone to court (I think) and got a County Court Judgement against you before you'll end up with any significant problems from late debt payment. Why is this not so in Sweden, are there laws about it or is it just the way Swedish companies operate?
I'm curious because I saw a report on SVT about this when Kronofogden were asking to remove the 3 year credit upfcukage thing. They interviewed some poor sod who ended up in hospital and as a result missed payments and got black marks which will not be removed even though he was in hospital. I mean FFS! You shouldn't have your credit ruined for getting sick, this is not America. |

Ah well, maybe they need one of us helpful immies to do it for them then. Actually I am helping someone with that, the last two months. The main problem is getting Law into an advocat's head, even though they are supposed to have learned it. Some advocats refuse to accept that European law is anything to do with Sverige, even though Sverige is a member of the EU and signed up to it all at international level. I am trying to find one in Southern Sweden who has an IQ that can actually be measured and has actually read a law book. One Advocat I had to give a copy of Blackstones EU law, just to get it into there head that EU Law covered Sverige. Advocats in Sverige are less than useless. |

In Sverige the credit companies maintain blackmarks as Kronofogen keeps people on there registrar permanently. Also how the credit companies operate in Sverige is actually illegal and challengeable under Europen Law. Some advice, got to School and learn European law or buy a book on the subject and read it.

In the UK, the county court can declare you bankrupt. After either 3 or 5 five years (can't remember which) you can become a company director and own your own business again. Self declaration of bankruptcy in UK is best. If a creditor drags you to court it will be a nightmare, that may drag well beyond the original timeframes covering bankruptcy. On the upside... At least the black marks last for 3 years as opposed to 7. Either way I think that it would be most fair to erase the black marks once the debt has been collected, that includes collection via garnishing wages and/or repossessing property + some kind of fine. |

I really can't understand why the government hasn't leapt on this. Kronofogden want the marks to be erased once paid, I cannot imagine there's a single person in the land who wouldn't agree with it, surely it's a total vote-winner?

Is there pressure coming from lending institutions and subscription-driven businesses to keep the current scheme? Those would be the prime groups I imagine would want to see a period of time to stay current with bills.
I can understand that they want to limit risk, but there has to be a better way than the black and white of the current credit scheme. |

Sucessful with what? I have seen the bankruptcy process in operation when I worked in a court just over a decade ago. In the UK it is weird and to be honest very rich people avoid the worst punishments, while the little guy gets it very bad. |

Credit rating agencies are only allowed to keep information about debt collection notices for three years (two years for credit card payments), so the idea that your missed payment would follow you for decades is complete bollocks. |
