19 months waiting for my sambo applicationI really need help |

Hej allihopa,
I am really really really worried as I have already been waiting for my sambo application to push through. I have not been even assigned a case officer. I am have Mexican and Honduran nationalities so basically in terms of passport I am totally screwed. But I speak 8 (including Swedish) languages and have 2 Masters degrees. One MBA with focus on climate science and one degree from Lund University in International marketing. I have also won an award for creating an energy saving app here in Sweden. I have been in Sweden all this time, as I have the right to stay until they reach a decision but I honestly really tired of waiting. I feel everyone telling me how Sweden needs capable professionals but they are taking ridiculously long to process my residence permit. I have a company who is interested in hiring me but they can't do so until I get this residence thing cleared. Do you know anyone who can help with this? Perhaps an immigration lawyer will be able to know who to talk to. The person I was referred to (not a case officer) doesn't answer her phone or reply to emails as well. It will be a shame for me have to move abroad again and leave my boyfriend behind just because of some ridiculous bureaucratic nonsense. Best Regards, Nat |

Have you repeatedly visited the MV office? Our experience 12 years ago, was that it was a waste of time calling. Go and explain to them that you have a job offer.

Sorry Nat but my experience was when I applied for sambo from within Sweden I have waited 27 months and then received a rejection. Some case officers also say that you are not allowed to apply for change of residence permit type from within Sweden anymore.

If it does I will spend the rest of my days there in a hunger strike if possible to get things done.

Hi Nat, I don't honestly know. The situation at MV has probably changed a lot because of the mass immigration. But in general, I prefer to deal with bureaucrats face to face. It makes it personal and gives you the chance to make a good impression, so that hopefully they will go the extra mile for you. Be nice, explain you understand they have a lot of work, dress professionally. If you have the job offer or a letter from the company which can confirm this in anyway, it's in MV's interest that you become a tax payer as soon as possible. Take your partner with you - so they can see that they are supportive. It can't hurt to make the effort.
The situation is insane - they allow in hundreds of thousands of undocumented and largely uneducated people, and make it hard for educated people who benefit the country. Perhaps you should also have a Plan B. Can your partner find work in another EU country? |

Hi, natinsweden -
If you have been residing in Sweden the entire time you described, and your last residence permit was still valid when you applied for your sambo permit, as you stated, you have a right to stay in Sweden while you await your decision. You also have a right to work while awaiting your decision. You do not need any additional work permit to take a new job. You are legally entitled to live AND work here right now. Yes, the wait is frustrating, but you can go on with your life as normal while you wait. That includes working. |

Hej Cheeseroller, Thank you for your advice is it greatly appreciated. Well I don't my partner can work outside of Sweden because he is a lawyer and he did study Swedish law, so it will be quite difficult for him to move somewhere else. I can easily get a job in China because I speak the language but he doesn't at all so he would have to move there to be a househusband I guess (haha). I will try to convince him to go with me to MV and see what we can get out of this. |

Hej Tenacious 185, Thank you for your information. Yeah I have been living here before under a student visa because I did a one year master's program in Lund. The problem is I never got a personal number because my residence permit was only given to me for 11 months and 2 weeks and not the whole year that is actually required to be entitled to one. My previous residence permit allowed me to work, but i never applied for a job before as the program was quite tough and required many hours of studying (stupid me I didn't know they were going to take so long). So that is why I am so stressed and frustrated I have no access to healthcare or even to buy any form of insurance because my status in Sweden is currently in "limbo". |

@hatim Guess what, people who work at MV are normal people. They make judgements and sometimes if you give someone a chance to help, they respond. Be a dick all your life and see how far that takes you.

First: I would encourage any one with similar problem to talk directly to MV and explain their situation. Second: Who suggested any one should be a dick. Be polite and professional. But also understand the system and don't confuse the jobs of different departments. Last: I don't agree that MV agents take into account if you will be a tax asset for Sweden. They follow laws set by parliament and guidelines derived from those laws by some suits in MV. As an applicant you can have a billion dollar in your bank account, but if you don't fulfil the "process" requirements you will not get the visa you seek. In OPs case it is simple, a new application MUST be made from home country since (s)he does not have a current valid visa (a new work visa CAN NOT be an extension in her/his case). There are some circumstances that could help (request from employer perhaps). But how much tax you will pay will NOT be a factor in MV for relaxing the requirement of application. |

I agree with Hatim. They always say that the main rule is to apply from your home country. Changing from one permit to another is not allowed anymore in Sweden. It used to be.

"apply from your home country". This depends on the nationality of her partner. If they are EU and not Swedish, she can apply within Sweden. This is what we did.

No, you can still apply from within Sweden. Here are the conditions under which you can do so:
https://www.migrationsverket.se/English/Pri...-in-Sweden.html As long as she applied while her study visa was still valid, it is acceptable to do so. Nat, I wasn't aware you had no personal number yet. That does make things much harder. technically you are still allowed to work, but many employers won't take the time to deal with the paperwork involved if you don't have that number. It might be best to just wait it out, unfortunately. If you have waited 19 months, it will probably happen soon(ish). Good luck. |
