Swedish Citizenship given, then taken away

Citizenship issue. Passport renewal denied

My son was born in the US to me, a Swedish citizen. When he was 22 Sweden and the US did not recognize dual citizenship. When he was 25 they did, so he went to the Seattle Swedish Consulate who recommended him to the now defunct Los Angeles Swedish Embassy. The Embassy walked him through the process of Swedish citizenship through application.

The application was approved through the Migrationsverket and he was issued a Swedish passport in 2005. He has since lived in the EU. In 2015 he went to renew his passport and it was denied and he was told he was not a citizen. This, of course, goes against all the facts: the approved citizenship application and the actual passport.

We have spent thousands of dollars on attorneys and trips to Sweden to locate important documents. All appeals have been denied.

I have been in touch with the Minister of Justice who has e-mailed me that Swedish citizenship cannot be rescinded, even if it was granted in error. That is 'the rule of law'.

The Migrationsverket Ombudsman agrees with that statement. But both of those parties have no idea what we can do with that information.

Where do we go from here? We are at our wits end with the inefficiency of the government and the various departments inability to communicate with each other. And we certainly can't afford more attorney work.

Hi Alan~

Thank you for replying to my post.

I assure you that I am not making this up. In looking back at my post I realize I may have confused some. Sweden did not allow dual citizenship until 2001, I believe. I apologize for including the US in that statement. And you are correct, Swedish law does not allow for revocation of citizenship. But it happened and we are now entering three years of trying to find the solution. It has wrecked havoc in our lives, both emotionally and monetarily.

As I wrote in my initial post, every agency we have been in touch with states just what you wrote but there seems to be no one who is willing to right the wrong.

Please understand that I am reaching out to this community not to cause conflict, but rather to resolve an important individual issue. Any help is greatly appreciated.

A person can also gain citizenship through application, which is what he did. It was approved and he then obtained his passport. When he went to renew his passport in Stockholm it was denied because they said he is not a citizen.

His approved citizenship application and his passport means that he is a citizen. It's hard to wrap my mind around really, so I can understand that new comers to this scenario find it confusing. Every advocate in Sweden we have spoken with and all government officials we have contacted all agree that those document prove citizenship. The frustration is that no one will correct the mistake.

Another solution in case he can not get back Swedish citizenship is that all EU countries give permanent residency permit to EU citizens invoking free movement right after five years of residency.

Furthermore, if he has received permanent residency permit and depending on which EU country he is residing in, and whether he was working or not. He could be eligible to receive citizenship of that country in most countries after five years of residency including the English speaking EU countries such as UK and Ireland. Thus he maintains an EU citizenship if that is what he intends to maintain.

Another question does he have a Swedish personnumer from skatteverket?

Migrationsverket is right.

Unless the mother is a Swedish citizen, the child must claim before the age of 18.
The issued it in error, and have a right to revoke due to error.

Savage...You are correct. After I posted here I told him and he said he did the same. What a good memory you have!

Svedallas...I assure you I am not leaving anything out of this story. Not trying to do anything but right a wrong. I was born and raised in Sweden oh so many years ago and am dismayed that the country I love is doing this to a person I love.
